Calcutta HC extends stay on West Bengal panchayat poll process

The Calcutta High Court today extended the stay on the panchayat poll process in West Bengal and said the State Election Commission’s withdrawal of a notification giving an additional day for filing of nominations was in question before it.Justice Subrata Talukdar extended the stay on the panchayat poll process till tomorrow morning when the matter would be heard again. He said that the Supreme Court had asked the SEC to allay apprehensions of the petitioner or any intending candidate, and in line of that the Commission had extended the nomination process by a day. It, however, withdrew the notification the very next day, which is in question before the court, the judge said, while hearing the SEC and the ruling Trinamool Congress’s challenge of his order to stay the elections.Representing the ruling TMC, its vice-president Kalyan Banerjee said the petitions challenging the decisions of the Commission was not maintainable, and that the court cannot interfere in an ongoing election process. He claimed that under Article 243(O) of the Constitution, no panchayat election shall be called in question, except by an election petition as per law made by the legislature of that state. Banerjee, also a TMC Lok Sabha MP, stated that the West Bengal Panchayat Act of 2003 provides that in case of any dispute in relation to panchayat polls, petitions can be moved before the civil court within 30 days after completion of election process. He asserted that how elections would be conducted is the prerogative of the SEC, and cannot be interfered into by the high court. The Supreme Court had in its April 9 order said, “We hope and trust that in order to ensure fair and free election to the panchayats, the State Election Commission shall take appropriate steps to remove the apprehensions of the petitioner (BJP) and/or intending candidates, and they may not be deprived of their chance to contest the panchayat elections.”Panchayat polls in West Bengal are scheduled to be held in three phases from May 1 to May 5, and the counting of votes is slated for May 8. The nomination process for the polls ended on April 9, but the SEC extended it by a day the same evening, following the apex court order. The notification was withdrawn by the SEC on the morning of April 10. The BJP moved the high court challenging the withdrawal, and Justice Talukdar stayed the election process on April 12. Apart from the BJP, the CPI(M) and the Congress, too, have moved the high court separately, challenging the SEC’s decision.

No objection to handing over Kathua rape and murder case to CBI: Union Minister Jitendra Singh

The Centre has no objection to the handing over of the Kathua rape and murder case to the CBI, provided the state government comes out with a reference, Union Minister Jitendra Singh said today.”As far as we are concerned, we don’t have any problem or objection to hand over the case to the CBI. If the state government comes out with a reference, we will hand over the case to the agency today itself,” Singh told reporters on the sidelines of a function here.He added that the court was another option through which the case could go to the CBI.”As per my knowledge, a petition (for a CBI probe) is pending there,” he said. The minister of state in the Prime Minister’s Office, however, refused to answer any further questions and left.An eight-year-old girl was kidnapped on January 10 and her body was found on January 17 in the Kathua district.During investigation, the state police’s crime branch alleged she was drugged and repeatedly raped before being killed.Eight persons, including a juvenile, were arrested in connection with the crime and their trial began yesterday in a court, where they pleaded not guilty and sought a narco analysis test. Many people in Kathua, including the families of the accused, have been demanding a CBI probe into the incident, which was, however, rejected by Chief Minister Mehbooba Mufti last month after two BJP ministers, Lal Singh and Chander Prakash Ganga, met her and raised the demand.?Both the ministers later resigned over their participation in a rally in support of people arrested in connection with rape and murder case. Yesterday, Jammu and Kashmir Governor NN Vohra accepted their resignations.

2019 polls may throw up a weaker coalition govt, predicts Morgan Stanley

With the general elections nearing, the street is likely to start pricing in on the poll outcome in the coming months, as there is a possibility of a coalition government coming to power. The Wall Street brokerage Morgan Stanley today said a weak coalition government is one of the biggest concerns for investors, which is a possibility in the 2019 hustings. And it is unlikely that the market will be as optimistic this time around as it was in the past election. “The world’s biggest democratic elections are 12 months away and the market is likely to start pricing in the election outcome in the coming months,” the report said. But “the market could always enter the past elections with the hope of a stronger government than the incumbent. This does not apply to the 2019 polls though where there is a possibility of a weaker government than the incumbent.”Hence, it is unlikely that the market is as optimistic as it has been in the past going into the 2019 general elections,” warns the Morgan Stanley report. But the brokerage was quick to add that “overall assessment of the current state of indicators favours the incumbent. Growth is looking up, inflation is stable, farmers’ sentiment is likely improving, transfers are rising, and jobs are coming back. However, the indicators may shift in the coming months-and together with them, the election outcome.” Basing its pessimism to the past five general elections, Morgan Stanley says while the usual approach of the market in the run-up to the polls is one of optimism, the big change from the past is that none of the elections since the mid-90s has started with a majority government in the run-up to the polls. The report also identifies economic indicators grouped in five categories — growth, inflation, farmer sentiment, direct benefit transfers — which if in good shape can result in re-election of the incumbent government. The brokerage feels that these economic indicators ignore the social and political debates which occupy the center stage in any election and to that extent, they are a simplification of estimating poll outcomes.
