Delhi Chief Minister Arvind Kejriwal will remain in jail as the Delhi High Court has reserved the order on his bail.

This means that the trial court’s Thursday’s order granting bail to Kejriwal will remain stayed till the time the High Court pronounces its order. This means that Kejriwal will remain in jail for now.

Earlier in the day, the Delhi High Court had stayed the trial court’s order granting bail to Kejriwal. The stay came as the HC heard the Enforcement Directorate’s (ED) petition challenging the trial court’s bail order.

Kejriwal is currently in jail on money laundering charges in the alleged Delhi Excise Scam. He is being probed by the ED.

The ED had argued before the HC that it did not get ample time to make its case against Kejriwal’s bail plea in the trial court.

In its bail order, the trial order had asked Kejriwal to furnish a personal bond of Rs 1 lakh. He was also told to not hamper the investigation and appear before the court whenever told to.

In the Delhi Excise Case, the ED had arrested Kejriwal in March. In March, he came out on bail for the duration of the Lok Sabha elections. After the campaigning ended on June 1, he was back in jail the next day.

Following Thursday’s bail order, the ED argued before the Delhi HC that Section 45 of the Prevention of Money Laundering Act (PMLA), the law Kejriwal has been slapped with, says an opportunity must be granted to the prosecutor to present their case but that opportunity was not granted at the trial order in this matter, according to PTI.

The agency further quoted the prosecution as arguing that that the trial court’s bail order had not been made available to them.

As the Delhi HC heard the case, it stayed the bail order until it passed an order on the ED’s challenge to the bail order. Then, later in the day, the HC reserved the order in the matter and, as a result, the bail order of the trial court will remain stayed till the pronouncement of the HC’s order in response to the ED’s challenge. This means that Kejriwal will remain jailed for now.
